उच्च न्यायालय ने अनुसूचित क्षेत्रों की शहरी निकायों में चुनाव रोका !!!

जी हां, आश्चर्यजनक, किंतु सत्य ! तथा सर्वथा सराहनीय एवं स्वागत-योग्य !

सच तो इ है कि खबर ज़रा पुराना है. खबर है कि मध्यप्रदेश उच्च न्यायालय की जबलपुर डिविज़न बेंच ने मध्यप्रदेश में अनुसूचित क्षेत्रों की शहरी निकायों में चुनाव रोका.

CIVIC POLLS IN SCEHEDULED AREAS STAYED
In an interim directive, the Madhya Pradesh High Court on Monday stayed holding of civic body elections in Scheduled Areas inhabited by tribals. A division bench of Chief Justice A.K. Patnaik and Justice Ajit Singh issued the directive during hearing of a bunch of PILs challenging the constitutional validity of section 1(2) of Madhya Pradesh Nagar Palika Adhiniyam 1961 where by civic bodies rules were executed in the state, including scheduled areas.

Arguing for the petitioners, senior advocate AM Trivedi said holding of civic bodies’ elections is not possible in the scheduled areas until parliament amends provisions of Article 243 of the Constitution. The counsel said the scheduled areas falling under the fifth scheduled of the Constitution deals with the administration and control of scheduled areas and scheduled tribes inhabited there. The scheduled areas are determined by the President, Trivedi said. The senior advocate said districts having cent percent scheduled areas include Jhabua, Mandla, Dindori Badwani and Anooppur. While districts having a portion of scheduled area include Dhar, Khrgone, Seoni, Ratlam, Shahdol, Umaria, Betul, Khandwa, Hoshangabad, Balaghat, Sheopur, Chhindwara and Sidhi, he said.

तो भैया, हमको इ तनिक बतलाइए कि हमरे झारखंड में एतना बड़ा अन्याय कैसे हो गया कि अनुसूचित क्षेत्र में नगर निगम और नगरपालिका का चुनाव हो गया ???

का ? किसी आदिवासी बुद्धिजीवी भाई-बहन ने इस धांधली का मुकाबला नही किया था ??

हां, किया था न भाई हमरे, श्री देबाशीष सोरेन, श्री विक्टर माल्टो के नैतिक समर्थन पर झारखंड उच्च न्यायालय में मामला दायर किये थे पर बेचारे वहां हार गये, पर हार नहीं माने, और अब उच्चतम न्यायालय का शरण लिये हैं. पूरा उम्मीद है जीतेंगे.

बात इ है कि जब पेसा कानून का धारा 4 (ओ) में लिखा है कि अनुसूचित क्षेत्रों में संविधान के छठी अनुसूची के तर्ज़ पर स्वशासी ज़िला परिषदों की स्थापना की जानी चाहिये और भूरिया समिति के अनुशंसाओं के हिसाब से स्वशासी ज़िला परिषद नगर समितियों या परिषदों का गठन करेगी और नगर प्रशासन के मामले, लोक स्वास्थ्य एवं स्वच्छता सहित, देखेगी तो कौन जरूरत है अलग से शहरी निकाय का ??
देखिये भूरिया समिति का अनुशंसा 35 (एफ) और (जी) और अनुलग्नक ‘डी’ का 1 (ई) और (एफ)

लेकिन हमरी झारखंड सरकार हाथ पर हाथ धरकर नही बैठी है. लगे हाथ झारखंड अनुसूचित क्षेत्र के और शहरी निकायों, जैसे चक्रधरपुर, मिहिजाम, आदि के चुनाव का घोषणा कर दिया है.
